Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the website at builtaxisdigital.com (the "Site") operated by BuiltAxis Digital ("we," "us," or "our"). By accessing or using our Site, you agree to be bound by these Terms.

If you do not agree with these Terms, you should not access or use our Site. Any paid services we provide are governed by a separate written service agreement that controls in the event of any conflict with these Terms. These Terms are not a substitute for a signed customer service agreement.

BuiltAxis Digital is a digital solutions company based in Kalamazoo, Michigan offering managed website design, setup, and hosting, CRM setup and customer management, appointment scheduling, business automation, AI-powered solutions, and digital marketing services (collectively, the "Services").

The specific scope, deliverables, timelines, support levels, and features of any engagement are established in the individual service agreement we enter into with each customer. Descriptions of Services on this Site are provided for informational purposes and do not constitute a guarantee of specific results or outcomes.

Some Services may rely on third-party platforms, integrations, or configurations. The availability of certain features depends on applicable setup and platform availability.

Our advertised service packages currently start at the following monthly rates, each subject to a one-time setup fee:

• Starter: $149/month plus a $399 one-time setup fee
• Growth: $249/month plus a $799 one-time setup fee
• Pro: $349/month plus a $1,499 one-time setup fee

All plans are month-to-month with no long-term service commitment, subject to the cancellation notice requirements in the signed customer agreement. All plans require a one-time setup fee. Final pricing may vary based on project scope and customization. Additional charges may apply for SMS and messaging usage, email, AI services, advertising, domains, and third-party integrations.

Your final pricing, billing obligations, and applicable fees are confirmed in the service agreement we enter into with you. In the event of any conflict between these Terms and your service agreement, the service agreement controls.

BuiltAxis Digital provides managed website design, setup, hosting, and ongoing digital services through monthly subscription packages. The one-time setup fee covers initial website design, configuration, and launch. The monthly subscription covers the services included in the selected package. Website hosting is included while the applicable subscription is active.

The setup fee does not automatically purchase a transferable copy of the website project or underlying platform. Customers retain ownership of their domain, branding, and original content, subject to applicable agreements and licensing restrictions.

Existing customers who no longer need CRM, automation, or marketing services may downgrade to a website-only hosting plan for $49 per month. Website-only hosting includes continued website publishing and hosting, connection to the customer's existing domain, and basic technical hosting maintenance. It does not include CRM access, automated follow-up workflows, appointment booking systems, managed lead capture forms, SMS or email marketing, AI automation services, or ongoing redesigns or content changes. Website-only hosting is a downgrade option for existing customers, not a new standalone website development package.

Standard domain setup and configuration assistance is included with all website packages. Customers who already own a domain may have BuiltAxis Digital configure the DNS settings and connect it to their website at no additional setup service charge. Customers who do not own a domain may choose our done-for-you domain registration and setup service, under which we help select an available domain, arrange registration, configure DNS, and connect the domain to the customer's website. There is no additional BuiltAxis Digital service fee for standard domain setup under an active website package.

Domain registration, renewal, premium domain, and third-party charges are separate unless expressly included in the customer's written agreement. Domain availability and registration are not guaranteed until completed.

Whether a customer already owns a domain or chooses to have BuiltAxis Digital handle the setup, the customer retains ownership of their registered business domain. Customer domains are registered in the customer's name or business name, with appropriate account and transfer arrangements. Domain ownership remains with the customer even if they discontinue BuiltAxis Digital services.

Subscriptions are billed month-to-month with no long-term service commitment. The duration of any subscription, renewal terms, cancellation notice period, refund eligibility, and termination procedures are defined in the individual customer service agreement. We do not impose a specific contract term, automatic renewal, cancellation notice period, or refund policy through these Terms that has not been agreed to in writing with BuiltAxis Digital.

If you cancel your full-service subscription, you may keep your website online through the $49/month website-only hosting plan. If you choose not to continue hosting, your website will be taken offline after the cancellation and transition period specified in your agreement. Your domain and original business content remain yours. CRM, automation, appointment booking, and other subscription-based services stop when the applicable subscription ends.

Customers may request their original content and agreed-upon transferable assets. The hosted website project and platform-specific configurations are not automatically transferred when a subscription ends. A customer's domain can be pointed to another provider; moving the website itself may require redevelopment because of platform limitations.

BuiltAxis Digital may offer SMS communications for appointment confirmations, appointment reminders, customer service messages, inquiry responses, and promotional messages where appropriate consent or another legally permitted basis applies. Marketing SMS consent is optional and is not a condition of purchasing any Service.

Mobile information, including phone numbers and SMS opt-in consent data, will not be shared with third parties or affiliates for their marketing or promotional purposes. Information may be shared with service providers solely as necessary to deliver communications and services requested or authorized by you.

The Site and its original content, features, and functionality are owned by BuiltAxis Digital and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our Site without our prior written permission.

Content, materials, and deliverables created for a customer under a service agreement are governed by the ownership and licensing terms set out in that agreement.

You agree to use our Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the Site. You may not use our Site to transmit unlawful, harassing, defamatory, or otherwise objectionable content, or to attempt to gain unauthorized access to any part of our Site or related systems.

Our Services may integrate with or rely on third-party platforms, tools, and service providers for hosting, CRM, booking, payment processing, and communications. We are not responsible for the practices, availability, or performance of third-party services outside of our control, and their use may be subject to separate terms and policies.

Our Site and Services are provided on an "as is" and "as available" basis. Except to the extent required by applicable law, we make no warranties or representations about the accuracy, reliability, or availability of our Site or Services, and we disclaim implied warranties to the fullest extent permitted by law.

To the maximum extent permitted by applicable law, BuiltAxis Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising from your use of our Site or Services. Our total liability for any claim arising from these Terms is limited to the extent permitted by applicable law and your service agreement.

These Terms are governed by the laws of the State of Michigan, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of our Site shall be resolved in the courts located in Kalamazoo, Michigan, to the extent permitted by applicable law.

We may update these Terms from time to time. Changes will be reflected on this page, and we will update the "Effective Date" above accordingly. We encourage you to review these Terms periodically. Your continued use of our Site after changes are posted constitutes acceptance of the updated Terms.
